Reforming notaries

The Ministry of Justice has prepared a draft document on the radical reform of the notaries.

The Ministry of Justice proposes a phased transition to the active model of the extrabudgetary notaries and its use to prevent civil and economic disputes. The corresponding draft presidential decree was published by the department for discussion on July 20, the press service of the Ministry of Justice said.

The project includes:

  • phased transfer of public notaries to non-state forms;
  • the organization of the Notary Chamber of Uzbekistan, identified its main tasks and activities;
  • cancellation of the procedure for mandatory notarization of certain types of agreements (transactions) and the introduction of new types of notarial actions;
  • simplification of the process of registration of contracts for the sale and purchase of housing to another person, rental of housing, transfer to gratuitous use by canceling certain requirements
    the introduction of a mechanism for the remote performance of notarial acts, including through videoconferencing;
  • civil liability insurance of notaries of not-public notaries to protect citizens from harm caused by the notary’s violation of his professional duties;
  • the provision of operational notarial services by improving the mechanism of electronic appeal to the notary.
    “Increasing material interest as a result of the transition to an active non-state form of notaries will ensure the provision of prompt and high-quality notarial services to the population and will serve its further development as an institution for preventing disputes,” the press service of the Justice Ministry said.
