The procedure for the examination of investment agreements was approved

The Decree of the President “On measures to further improve the procedure for conducting an examination of pre-project documentation for investment and infrastructure projects, procurement documentation for a tender, terms of reference for public procurement and contracts” (No. 332 of July 25, 2022) was adopted.

In accordance with the Decree, the fee for the examination of procurement documentation for the tender and terms of reference for public procurement, draft contracts, is calculated in the amount of 0.1 percent of the cost of the subject of procurement, excluding VAT, but not more than 100 times the size of the RFP, and is charged from adding VAT to this amount.

The fee for conducting a comprehensive examination of the feasibility study of projects is calculated in the amount of 0.03 percent of the total project amount, excluding VAT, but not less than 4 thousand US dollars and not more than 50 thousand US dollars in equivalent, and is charged with the addition of VAT.

For conducting a comprehensive examination of the feasibility study of projects, a fee is charged in the amount of 50 percent of the amount established for conducting a comprehensive examination of the feasibility study of projects.

The examination is carried out with the condition of 100% prepayment.

The Decree approved the provisions governing:

  • development, comprehensive examination and approval of project documentation for investment and infrastructure projects;
  • the procedure for conducting a comprehensive examination of the procurement documentation for the tender and the terms of reference for public procurement;
  • the procedure for conducting an examination and registration of draft contracts, import contracts and additional agreements thereto;
  • the procedure for determining the cost of services for conducting a comprehensive examination of the feasibility study and feasibility study of projects, procurement documentation for the tender and terms of reference for public procurement.
